Filling a New Application 

When a company needs to file a trademark, the first step is to file a new application. However, it may get a rejection according to the norms of the government. The firm fills in the form with a detailed description and sends it to the registry.

Sending the application to Vienna Codification

There are various codes in Vienna codification. According to the logo or device trademark, the code is assigned to the trademark. Vienna codes are universally acceptable.

Formality pass

As the name suggests, it is a formality check pass. It is a check pass for the verification of all the details and requirements are as per the norms of the act. It is carried forward to the examiner for examination.

 

Formality fail

When the requirements or details are incorrect or missing, the examiner fails the application.

 

Sent back to Electronic Data Processing

In this status, the applicant has to do nothing. It is for the Trademark office. Sometimes there may be an error with the data entry of the application.

 

PRAS

PRAS- short form of Pre-registration Amendment section. They are the prime authority concerned with the correction of data entries. They are concerned about the amendment before the trademark registration.

 

Marked For Exam

When the trademark has the status of "marked for the exam", it tells that examiner will be examining the application for the prerequisites and details of the application.

Examination Report

When the trademark is acceptable by the registry, it receives the examination report. However, it is not yet in the journal of the trademark.

 

Objection

When an objection status is in the display of the applicant, the applicant has to reply to the report within a maximum time frame of 1 month from the date of receipt. It is shown as objected when examined by higher authorities and is refused under various sections of the trademark act.

 

Abandon

When the applicant fails to respond within a time limit, the application abandons.

 

Accepted

After all the processes when the examiner clears the application without raising any objection, it is going to get its place in the trademark journal

 

Advertise before Accepted

Sometimes application receives the status of "Accepted before Advertisement", It happens when the officer can find strong proof of commercial acceptance, and the mark can be used in such cases.

Advertise after Acceptance

When the status is Advertised and accepted, it states that the trademark has made its place in the trademark journal. Now that the trademark is in the journal, it is open for the public to file an opposition in the prescribed time.

 

Show Cause Hearing

The status of show cause hearing appears when the applicant's reply to the examination report was not satisfactory and not accepted by the trademark registry. The trademark receives a date for the hearing, and the applicant needs to be present for the subject.

 

Refusal

When the examiner is not happy with the reply to the report, he gives the status of refusal to trademark. The authority can refuse the trademark on the grounds available under Trademark Act.

 

Opposed

The status of opposition is available when someone has filed against the trademark within the given time frame.

 

Registration

When the trademark passes all the phases and even after receiving the objection but the result is in the favor of the applicant. 

 

Removal

When the firm doesn't renew the trademark after the tenure of 10 years, the obtained status removes. Afterwards, the applicant needs to pay the renewal fee for the trademark status.

 

Withdrawal

When the person wants to withdraw the application, the person needs to submit the abolition letter to authority in writing.
