Delhi Lieutenant Governor Anil Baijal has issued a notification, granting power to the Delhi Police Commissioner to apprehend anyone under the National Security Act (NSA) till October 18.
The notification, issued on July 22, said “Now, therefore, in exercise of the powers conferred by sub section (3) of section 3, read with clause (e) of Section 2 of the National Security Act, 1980, the Lt Governor of the National Capital Territory of Delhi is pleased to direct that during the period between July 19, 2021 to October 18, 2021, the Commissioner of Police, Delhi may also exercise the powers of detaining authority under sub section (2) of the section 3 of the aforesaid Act.”
The Delhi High Court on Tuesday issued notice on a plea, challenging the constitutional validity of the GNCTD Amendment Act, which has enhanced the powers of the Lt Governor in Delhi over the elected government.The petition challenged the Government of NCT of Delhi (Amendment) Bill, 2021, which received the assent of the President on March 28, 2021, seeking a stay on the Amendment Act, in view of the prevailing pandemic conditions.KC Agarwal, Counsel for the petitioner, said that a similar petition has been filed, in which a notice has been issued.
