BREAKING: Wearing Hijab Not Essential Religious Practice of Islam, Rules Karnataka HC

The Karnataka high court today delivered its Judgment in the hijab controversy, which erupted earlier this year after a school barred hijab-wearing students from entering its premises.

The Court held that wearing of Hijab is not part of essential religious practice of Islam.

Questions formulated by Court:

A- Whether wearing hijab is essential religious practice under Islam? 

B- Whether wearing hijab is essential religious practice under Islam?f freedom of expression and right to privacy?

C- Whether GO of February 5 was issued without application of mind and manifestly arbitrary?

The Court Answered:

A- Wearing of hijab by Muslim women not part of essential religious practice under Islam.

B- Prescription of school uniform is only a reasonable restriction which Students cannot be object.

C- Government has power to issue Government Order.

The 3 judges bench of Justices Ritu Raj Awasthi, Justice JM Khazi, and Justice Krishna S Dixit deliverd its verdict at 10.30 a.m. today, following a marathon hearing of nearly 23 hours spread over 11 days between February 10 and 25.
