There is a common court marriage procedure throughout India. By the Special Marriage Act, 1954, it can be solemnized between two parties who are interested in getting married. Further, the Act allows parties belonging to the same or different religions to marry by civil ceremony.

  1. Validation of previous marriages: Neither party should have a living spouse. As a result, previous marriages should no longer be valid.
  2. To give valid consent, both parties must be competent. The parties should also be capable of speaking their minds and entering into a marriage of their own accord.
  3. Females must be 18 years of age and males must be 21 years of age.
  4. Children should be able to be conceived by neither party if they are fit for procreation.
  5. It shall be valid, however, if the customs and traditions of the religion of any one of the parties permit such a relationship.

There are six steps involved in a court marriage in India, which must be completed physically instead of online. Those steps are the application for marriage, the publication of the notice, objections to the marriage, the place of the wedding, and the signing of the declaration by the bride and groom.
